Fentanyl Possession and Distribution Penalties Initiative
Plain-English Summary
This measure proposes to make possession of any amount of fentanyl a felony and increase penalties for fentanyl distribution. It also includes provisions for vacating convictions upon successful completion of court-ordered drug rehabilitation.
What each outcome does
If this initiative passes, possession of any amount of fentanyl would become a level-four drug felony, with potential for conviction vacation after rehabilitation. Penalties for possession with intent to distribute would also be stiffened.
If this initiative fails, current Colorado laws regarding fentanyl possession and distribution would remain in effect. Possession of less than 1 gram of fentanyl would not automatically be a felony, and existing penalties would apply.
